VAT on Real Estate Brokerage Commission in the UAE: Practical Examples

Yes. A VAT-registered UAE broker generally charges 5% VAT on commission for arranging a sale or letting of UAE property. The charge is on the brokerage fee. An exempt residential property transaction does not automatically make the broker’s separate service exempt. [1, 2]

Imagine handing over the keys to an apartment, then receiving this question: “The rent has no VAT, so why have you added VAT to your commission?”

The answer starts with two separate supplies: the landlord provides the home; the agency provides the brokerage service. This guide helps UAE agency owners, accounts teams and customers calculate the fee, understand the invoice and keep a clear record of the transaction.

Why residential property does not make the commission exempt

The FTA treats estate-agent services as services connected with real estate. The property’s VAT classification must be assessed separately. Ordinary residential lettings can be exempt; a qualifying first supply of a new residential building within three years of completion can be zero-rated. Neither treatment automatically passes to an independent broker’s fee. [1, 2]

This article assumes a VAT-registered broker established in the UAE, an ordinary brokerage service and property situated in the UAE. Overseas property, unusual agency arrangements and supplies within a VAT group need their own review.

How to calculate VAT on real estate commission

All examples below are illustrative. The commission percentages are agreed assumptions, not legally fixed rates. Amounts are in AED.

Example 1 A residential sale

A buyer purchases an apartment for AED 1,000,000. The agency’s agreed fee is 2% of the price, excluding VAT.

CalculationAmount
Commission: 1,000,000 × 2%20,000
VAT on commission: 20,000 × 5%1,000
Total agency invoice21,000

The broker’s AED 1,000 VAT is calculated on its AED 20,000 service fee. Do not calculate the broker’s VAT as 5% of the apartment’s value. Any VAT treatment of the property sale is a separate assessment.

Commission example: AED 20,000 fee plus AED 1,000 VAT equals AED 21,000 payable

Example 2 An annual residential letting

Assume annual rent of AED 100,000 and an agreed agency fee of 5% of annual rent, excluding VAT. Commission is AED 5,000, VAT is AED 250, and the agency invoice totals AED 5,250. The landlord’s rent and the agency invoice should remain separate in the customer’s explanation and the broker’s records.

Example 3 A VAT inclusive fee

If the agreed total is AED 10,000 including VAT, extract the VAT rather than adding it again:

• Net commission: 10,000 ÷ 1.05 = AED 9,523.81.

• VAT: 10,000 × 5 ÷ 105 = AED 476.19.

• Total: AED 10,000.00.

Confirm the fee terms before sending a quotation. Clear wording about VAT prevents the agency and customer from budgeting different totals. Publicly displayed prices generally include VAT; VAT-exclusive pricing is permitted only in the circumstances set out in the regulations. [2, Article 27]

What if the customer lives outside the UAE

An overseas address or payment from a foreign bank does not, by itself, make UAE property brokerage an export at 0%. Services directly connected with UAE real estate have a UAE place of supply, and the ordinary export-of-services relief excludes services directly connected with UAE property. [1, 2, Articles 21 and 31]

For example, a buyer living in London appoints a Dubai agency to arrange a specific Dubai apartment purchase. Assume a fee of AED 30,000 excluding VAT and the same ordinary brokerage facts as above. The agency bills AED 1,500 VAT, giving a total of AED 31,500.

Keep evidence of the property location and what the agency actually did. General market research or advertising is not necessarily treated in the same way as brokerage for a specific property. [1]

How should two agencies handle a commission split

Start with the contracts: who supplies which service, and to whom? A 50/50 cash split does not answer that question.

Illustrative subcontracting arrangement: Agency A contracts with the customer for the entire service at AED 20,000 plus VAT. Agency B separately supplies brokerage support to A for AED 10,000 plus VAT. Both are VAT registered, are outside a VAT group, and the services relate to UAE property.

InvoiceNet feeVATTotal
Agency A to customer20,0001,00021,000
Agency B to Agency A10,00050010,500

Under these assumptions, A records AED 20,000 commission income and AED 10,000 subcontract cost. Its output VAT is AED 1,000; the AED 500 on B’s invoice is considered separately for input-tax recovery. If fully recoverable in the same period, these two invoices contribute AED 500 net VAT payable by A, before its other transactions. [2, 4]

Do not simply record AED 10,000 revenue because that is A’s retained share. A different contractual model—such as each agency supplying the customer directly—can require different invoices and accounting. Ask for the agreement before posting the split.

Does the broker count the property price for VAT registration

A UAE-resident business must register when relevant taxable supplies and imports exceed AED 375,000 over the previous 12 months, or are expected to exceed that amount in the next 30 days. Voluntary registration may be available above AED 187,500 of relevant supplies, imports or taxable expenses. [3]

For an ordinary disclosed broker supplying only agency services, the seller’s property value is not the broker’s own sales turnover. For example, 20 deals with AED 20,000 commission each produce AED 400,000 commission before VAT, irrespective of the combined property prices. Review other taxable activities and imports too. Acting in your own name or buying and reselling property changes the analysis. [4, Article 9]

What should a brokerage VAT invoice show

For an ordinary full tax invoice, check the following particulars under Article 59. [2]

CheckPractical instruction
IdentityDisplay “Tax Invoice”, the supplier’s legal name, address and TRN. Include the customer’s name, address and TRN where the customer is registered.
Reference and datesUse a sequential or uniquely identifiable invoice number, issue date and supply date if different.
ServiceDescribe the brokerage service; adding the property reference helps reconcile the deal.
ValuesShow unit price, quantity or volume, VAT rate, net amount, discounts, gross total and VAT amount in AED. Include the exchange rate where required for foreign currency.

The table combines legal invoice particulars with the practical suggestion to identify the property. It is a checklist, not a completed tax invoice.

When must the invoice be issued

For a normal one-off service, the date of supply is generally the earliest of service completion, receipt of payment or issue of a tax invoice. Advance payments can therefore create a VAT obligation before the final settlement. Periodic-payment contracts have separate timing rules. [4, Articles 25 and 26]

Full tax invoices generally must be issued within 14 days of the date of supply. Simplified tax invoices must be issued on the date of supply. Summary invoices have their own deadline. The simplified option depends on the customer and transaction; mandatory or voluntary use of the prescribed electronic invoicing system changes the applicable invoice rules. [2, Article 59; 5]

For example, if an ordinary brokerage service is completed on 9 October 2026 and there is no earlier invoice or payment, a full tax invoice would normally be due by 23 October 2026. If using a permitted simplified invoice, issue it on 9 October. Do not postpone the tax point just because the customer pays later.

Can VAT on brokerage costs be recovered

Recovery depends on the recipient’s business use and the applicable conditions, including invoice, payment and supplier-verification requirements. A broker incurring costs for taxable commission income may recover eligible input VAT. A landlord’s commission cost directly related to exempt residential letting generally does not qualify. VAT registration alone does not make every expense recoverable. [1, 2, 4, 7]

Treat an agency’s service costs and a landlord’s letting costs as separate cases. If a business makes both taxable and exempt supplies, review the current apportionment rules before calculating a claim.

A practical checklist before filing

Five brokerage VAT checks: contract, property, invoice, reconciliation and return

1. Read the agreement. Confirm the recipient, commission basis, VAT wording and any sharing arrangement.

2. Identify the property and service. Record the location and distinguish brokerage from other services.

3. Match the invoice to the deal. Check dates, TRNs, figures and supporting supplier documents.

4. Reconcile the money. Explain advances, part-payments, unpaid invoices and amounts held for other parties.

5. Review the VAT return. Reconcile output tax and eligible input tax separately, then retain the filed return and payment confirmation.

Taxograph’s bookkeeping services can help keep the deal register, commission invoices and bank receipts aligned.

VAT returns and related payments are normally due within 28 days after the tax period ends. For a period ending 30 September 2026, the normal deadline is 28 October 2026. Check the assigned period and due date in EmaraTax. [6]

Frequently asked questions

Is VAT charged on the commission or the property price

On the brokerage invoice, calculate VAT on the agency’s service fee. Example 1 shows AED 1,000 VAT on AED 20,000 commission. Assess the property sale separately.

Can the broker charge VAT if it is not registered

Only registrants issue tax invoices. An unregistered business should check whether registration is already required; failing to register does not remove an existing tax liability. Customers should ask for the agency’s TRN and an appropriate invoice. [3, 5]

Does an overseas buyer avoid VAT on the agency fee

An overseas address does not change the ordinary treatment for brokerage directly connected with UAE property. Check the property location and the actual service. [1, 2]

Is a 2 percent brokerage commission compulsory

The 2% used here is an example, not a statement of a mandatory brokerage rate. Read the signed agreement and applicable real estate rules. The commission percentage and the VAT rate are different figures.

Should we add VAT again when the fee already includes it

No. For a 5% VAT-inclusive fee, use total × 5 ÷ 105 to extract VAT. Keep the customer’s agreed gross total unchanged, as in Example 3.
